For Talent (Models & Actors – aged 18 and over):

  • Professional Information: Headshots, comp cards, resumes, portfolios, video reels, measurements (height, weight, clothing/shoe sizes, etc.), skills, experience, union status, nationality, right to work information (e.g., visa status if applicable).

  • Identification Information: Date of birth (for age verification and casting purposes), and potentially government-issued ID (for verification purposes, with consent).

  • Financial Information: Bank account details (for payment purposes if a booking is secured, with consent).

For Clients (Casting Directors, Production Companies, etc.):

  • Contact Information: Name, company name, email address, phone number, business address.

  • Project Information: Details about casting needs, project descriptions, budgets (where applicable).

For Website Visitors:

  • Technical Information: IP address, browser type, operating system, referring URLs, pages visited, and dates/times of visits (collected via cookies and similar technologies – see Section 9).

  • Clients/Casting Directors: By agreeing to representation with MoMo Talent and providing us with your professional materials, you acknowledge and agree that we will create a talent profile (including photos, videos, resumes, and relevant stats) and share this with potential clients (casting directors, production companies, etc.) for suitable casting opportunities. We will endeavour to discuss specific or sensitive opportunities with you where appropriate.

  • Service Providers: Third-party vendors who assist us with website hosting, data storage, email communication, payment processing, and other operational services. These providers are contractually obligated to protect your information.

  • Legal Authorities: If required by law, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, investigate fraud, or respond to a government request.

  • Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our assets, your personal information may be transferred as part of the transaction.

We do not sell your personal information to third parties.

Our service provider, Zoho, which we may use for services such as client relationship management, email communications, and website hosting, has implemented specific measures to safeguard UK data. These include registration with the UK's Information Commissioner's Office (ICO), appointment of a local UK representative, adherence to international security standards (such as ISO/IEC 27001, ISO 27017, ISO 27018, and SOC 2 Type II), encryption of data both in transit and at rest, and strict access controls. We rely on these measures and Zoho's contractual commitments as part of our safeguards for any international data transfers they may undertake.

Your access to and use of the Site and our services is conditioned upon your acceptance of and compliance with these Terms.

If you disagree with any part of the terms, then you do not have permission to access the Site or use our services. You must be at least 18 years of age to use this Site and our services. By accessing or using the Site or our services, you represent and warrant that you are at least 18 years of age.

Description of Services MoMo Talent is a talent agency that specializes in the representation of models and actors ("Talent") for various assignments, including, but not limited to, print, runway, commercial, film, television, and promotional work. We connect Talent with clients, casting directors, and production companies ("Clients") seeking to engage such Talent.

3. Talent Submissions (For "Join Us" Page)

  • Accuracy of Information: If you submit your information for representation, you warrant that all information provided (including, but not limited to, photographs, videos, resumes, measurements, and contact details) is true, accurate, current, and complete. You must be at least 18 years of age to submit your information for representation.
  • No Guarantee of Representation: Submission of your materials to MoMo Talent does not guarantee representation or an offer of representation. We review all submissions and will contact individuals if we see a potential fit. Should MoMo Talent wish to offer representation, this will be subject to a separate Representation Agreement.
  • Material Ownership: You retain ownership of the materials you submit. However, by submitting materials, you grant MoMo Talent a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute these materials for the purpose of evaluating your potential for representation and, if represented, for promoting you to Clients.
  • Professional Conduct: Talent represented by MoMo Talent are expected to maintain the highest level of professionalism in all dealings with MoMo Talent, Clients, and in relation to any assignments. Specific conduct expectations and consequences for breaches may be further detailed in your Representation Agreement.

4. Client Engagements Clients seeking to book Talent through MoMo Talent agree to provide accurate and complete information regarding their project and casting requirements. Specific terms of engagement for any Talent booking (including fees, usage rights, and payment terms) will be outlined in a separate booking agreement or contract between the Client, MoMo Talent, and/or the Talent. MoMo Talent acts as an agent and is not responsible for the conduct of Clients or Talent outside the scope of the formal booking agreements.

5. Intellectual Property

  • Site Content: The Site and its original content (excluding materials submitted by Talent or provided by Clients), features, and functionality are and will remain the exclusive property of MoMo Talent Limited and its licensors. The Site is protected by copyright, trademark, and other laws of the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of MoMo Talent Limited.
  • Talent Materials: As stated in Section 3, Talent retain ownership of their submitted materials. Clients are granted rights to use Talent materials only as specified in individual booking agreements.

6. User Conduct You agree not to use the Site or our services:

  • In any way that violates any applicable national or international law or regulation.
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
  • To impersonate or attempt to impersonate MoMo Talent, a MoMo Talent employee, another user, or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which, as determined by us, may harm MoMo Talent or users of the Site or expose them to liability.

7. Disclaimers The Site and our services are provided on an "AS IS" and "AS AVAILABLE" basis. MoMo Talent makes no warranties, express or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. MoMo Talent makes no representations or warranties regarding the accuracy, likely results, or reliability of the use of the materials on its Site or otherwise relating to such materials or on any sites linked to this Site. MoMo Talent does not guarantee that Talent will secure any bookings or assignments.

8. Limitation of Liability In no event shall MoMo Talent Limited, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Site or services; (ii) any conduct or content of any third party on the Site or through the services; (iii) any content obtained from the Site or services; and (iv) unauthorized access, use, or alteration of your transmissions or content—whether based on warranty, contract, tort (including negligence), or any other legal theory—whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Indemnification You agree to defend, indemnify, and hold harmless MoMo Talent Limited and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including, but not limited to, attorney's fees), resulting from or arising out of: a) your use of, and access to, the Site and services; b) any breach by you of these Terms; or c) any content or material you submit, post, transmit, or make available through the Site or services.

Termination We may terminate or suspend your access to the Site and our services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including, but not limited to, a breach of the Terms.
